General Terms and Conditions

General Terms and Conditions of DATAsoft Webservice GmbH for the use of porno-casting.net

§ 1 Scope and Provider

(1) porno-casting.net is a service of DATAsoft Webservice GmbH, Friedrichstraße 155, 10117 Berlin, registered in the commercial register of Amtsgericht Charlottenburg (Berlin) under HRB 271333 B, represented by its managing director Ben Kusche, e-mail: info@porno-casting.net, telephone: +49 30 20965-6680 (hereinafter “we” or “us”).

(2) These General Terms and Conditions (General Terms and Conditions) apply to all contracts between us and the users of porno-casting.net, in particular to applications, accounts, profile cards, placement with productions, messages, verification, orders from productions and the referral programme. They apply in the version valid at the time the respective contract is concluded.

(3) Any deviating, conflicting or supplementary terms and conditions of users shall not become part of the contract unless we expressly agree to their validity in text form. Individual agreements shall take precedence over these General Terms and Conditions.

(4) A consumer is any natural person who enters into a legal transaction for purposes that cannot predominantly be attributed to their commercial or self-employed professional activity (§ 13 BGB (German Civil Code)). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity (§ 14 BGB).

§ 2 Definitions

• Performers are female performers, male performers and couples who apply or create an account with a profile card.
• Productions are businesses seeking performers for photo, video, livecam or other adult productions and using a production account for this purpose.
• Profile card is the profile of a performer in the performer database containing information, photographs and, where applicable, videos.
• Activation is a production’s access to the restricted information on a profile card, in particular contact details, terms and conditions and unmasked recordings.
• Tokens are a credit balance held by productions and used for activations and highlighted job offers.

§ 3 Services of porno-casting.net

(1) porno-casting.net is a platform where performers and productions in the field of erotic and adult productions can find one another. In particular, we offer: applications to us and placement by our team, a performer database with profile cards, job offers from productions, a messaging system, verification of age and identity, a filming agreement template, suggestions for suitable jobs and profile cards, a referral programme, and editorial information in the Magazine and Glossary.

(2) Contracts concerning filming, shootings or other engagements (production contracts) are concluded exclusively between the performer and the production. We are neither the employer nor the client of the performers and are not a party to the production contracts. We do not owe any successful placement, any particular number of enquiries or any booking. The contracting parties themselves are responsible for the performance of production contracts, in particular for fees, working conditions and the use of recordings.

(3) Information in the Magazine, Glossary, Earnings calculator and concerning fees is of a general nature. It does not replace legal, tax, health or social security advice in individual cases.

(4) We may further develop the platform and modify, restrict or discontinue individual free-of-charge functions, insofar as this is reasonable in consideration of the users’ interests. We provide paid services for the agreed term and to the agreed extent.

§ 4 Registration and Account

(1) The use of porno-casting.net is permitted exclusively to persons who have reached the age of 18. Production accounts may only be created by entrepreneurs within the meaning of § 14 BGB or by persons acting for a business and authorised to do so.

(2) When applying and registering, true, complete and up-to-date information must be provided, and any changes occurring subsequently must be updated in the account. Each person may maintain only one account as a performer; couples may create a joint profile card if both persons are of full age and have consented. Accounts are not transferable.

(3) Login details and login links must be kept confidential and must not be made accessible to third parties. If there is a suspicion that third parties have gained access, we must be informed of this without undue delay.

(4) By submitting an application or registering, the person submits an offer to conclude a free-of-charge usage agreement. The contract is concluded when we activate the registration by confirming the e-mail address or accept the application. There is no entitlement to registration, acceptance of an application or publication of a profile card.

§ 5 Full Age, Verification and Proof of Age

(1) Cooperation with productions is permitted exclusively with persons of full age. Before the first recording, full age must be proven by presenting a valid official photo ID (identity card or passport). No recording shall take place without proof. Irrespective of verification on porno-casting.net, productions are required to independently verify and document the age and identity of all participants before every recording.

(2) We offer verification of age and identity, either as video verification by our team or as an online check via an external verification service. Details of data processing are provided in the Privacy Policy. Successful verification is displayed as a “Verified” notice with the date and is valid for 24 months. We may require that a profile card be published only after successful verification or that only verified productions be permitted to activate profile cards.

(3) Verification confirms age and identity at the time of the check. It does not constitute a guarantee of the accuracy of any other information and does not replace the production’s own check pursuant to paragraph 1.

(4) If it becomes apparent that a person is underage or has deceived others as to their identity, we shall immediately suspend the account and remove all content. If there is a suspicion of criminal offences, we shall inform the competent authorities.

§ 6 Costs for Performers and Verification Fee

(1) Applications, profile cards and referrals to productions are free of charge for performers. We do not retain any commission from the fee; for referrals made by our team, we are remunerated by the production.

(2) A one-time verification fee may be charged for certain accounts. Whether a fee is charged and, if so, in what amount, is displayed to the person concerned in their Customer area before the verification begins. The displayed amount is a final price including statutory value-added tax. No amount is displayed for persons who are not subject to a fee; verification is free of charge for them.

(3) The fee must be paid before the verification begins. Verification begins after receipt of payment. The fee is charged only once per account. If verification has to be discontinued or repeated for technical reasons, no additional costs will arise. Renewed verification after expiry of the validity period is also free of charge.

(4) The information stated on the official identity document applies. If the information on the profile card differs from this and no fee is payable according to the information on the identity document, we will fully refund any fee already paid. If a fee is payable according to the information on the identity document but has not yet been paid, the “Verified” designation will be added only after payment; no renewed verification is required for this.

(5) If verification is rejected because the person is a minor, we will fully refund any fee paid. If verification is rejected for other reasons, for example because an invalid or another person’s document was submitted, the fee for the verification carried out remains payable. We may waive the fee in whole or in part on a case-by-case basis.

(6) If a payment is charged back or revoked, the fee will be deemed unpaid. No new verification can be started until payment has been made, and we may remove the “Verified” designation.

(7) Refunds will be made via the payment method used for the payment, unless otherwise agreed.

§ 7 Conclusion of Contracts for Chargeable Services

(1) The presentation of chargeable services on porno-casting.net does not constitute a legally binding offer, but an invitation to place an order. By clicking the button for the chargeable order (for example, “place order with obligation to pay”), the user submits a binding offer. Before submission, the service, price and payment method are displayed and entries can be corrected using the browser’s back function or in the Customer area. The contract is concluded upon confirmation of the order on the website or by e-mail.

(2) The payment methods displayed during the ordering process are offered, in particular payment via the payment service provider Pay4Coins (CIPA Media S.L.U., Spain) and bank transfer. If payment is made via a payment service provider, its terms and conditions shall apply additionally. In the case of a bank transfer, the amount must be paid without deductions to the account specified in the order confirmation.

(3) The contract language is German. We store the contract text and send the contract details by e-mail with the order confirmation. The General Terms and Conditions applicable at any given time can be accessed on this page at any time and may be saved or printed.

(4) Consumers are entitled to a right of withdrawal in accordance with the withdrawal notice.

§ 8 Obligations of Users

(1) Users may use porno-casting.net only within the scope of the applicable laws and these General Terms and Conditions. In particular, the following is prohibited:

• posting content that depicts minors, concerns minors or gives the impression of depicting a minor, including role-playing involving minors,
• posting pornographic depictions within the meaning of § 184 StGB (German Criminal Code), or content that depicts or glorifies violence, sexual acts without consent, sexual acts with animals or other depictions prohibited under §§ 184a–184c StGB,
• posting images, videos or information concerning other persons without their consent,
• infringing third-party rights, in particular copyrights, trademark rights and personality rights,
• providing false information concerning a person, age, identity, company or verification status, or impersonating another person,
• offering or seeking prostitution or sexual services in return for payment that do not serve the production of photographs or film recordings,
• harassing, threatening, coercing or putting other users under pressure, in particular to perform acts outside agreed boundaries,
• demanding advance payments, fees or commissions from performers or reducing fees without an agreement,
• collecting contact details, automatically extracting profile cards, sending advertising or spam, or using the platform to circumvent contact blocks,
• circumventing technical protective measures, in particular image protection and the blocking of contact details.

(2) Anyone who uploads images or videos warrants that they possess all rights required for this purpose, that all persons depicted were adults at the time of recording and consented to the recording and its publication on porno-casting.net, and that they can provide evidence of this upon request.

(3) If a user culpably breaches these obligations, they shall indemnify us against third-party claims based on this breach, including the reasonable costs of legal defence. Further claims remain unaffected.

§ 9 Content and Rights of Use

(1) The rights to photos, videos and texts uploaded by users remain with them or the respective rights holders.

(2) For the duration of publication, users grant us the non-exclusive, non-transferable, royalty-free right to store, reproduce and make the uploaded content publicly accessible on porno-casting.net and to technically edit it for display, insofar as this is required for operating the platform. This includes, in particular, reducing the size and cropping, creating obscured preview images and translating free-text content into the languages offered on porno-casting.net. Use outside porno-casting.net, for example for advertising in other media, shall not take place without separate consent.

(3) The right of use ends when the content or the set card is deleted. Technically necessary backup copies are overwritten as part of the regular backup cycles.

(4) Recordings from a casting shall only be published or exploited with the separate, express consent of the person depicted.

§ 10 Set Card, Image Protection and Activation

(1) After our review, set cards are published in the performer database. Performers can pause, modify or delete their set card at any time.

(2) Visibility is graduated: Certain information and the set card image are public, while further information is available only to registered productions. Further photos are displayed in obscured form to visitors without activation, and videos and contact details are blocked. Details are set out in the Privacy Policy.

(3) Productions can activate a set card using Tokens. Upon activation, they receive permanent access to the blocked information of that particular set card. Performers agree, by publishing their set card, that productions activating it may use this information to initiate a collaboration.

(4) Productions may use activated contact details, photos and videos exclusively to contact the performer regarding a specific collaboration. Disclosure to third parties, publication or any other use is prohibited. If the performer does not wish to have any further contact, this must be respected.

§ 11 Placement by Our Team

(1) If we place a performer with a production, we disclose their data only with their consent in the individual case and only to the extent necessary.

(2) Before each placement, the performer records in writing which activities are excluded. This declaration forms part of the production contract. Any inquiry may be rejected without giving reasons; this shall not result in any disadvantages for future inquiries. Consent to individual activities may be revoked at any time up to the start of recording.

(3) A recording may be terminated at any time. If it is terminated because the production has breached the agreed limits or safety and health requirements, the entitlement to the agreed fee shall remain unaffected.

(4) The amount of the fee, the payment method and the due date shall be agreed in writing in the production contract before each engagement. The scope of the rights of use granted in respect of the recordings shall likewise be regulated in the production contract and explained before it is signed.

(5) The following applies to placements by our team: Condom use is mandatory without exception for vaginal and anal intercourse. For productions involving sexual intercourse, test certificates that are no more than 30 days old must be submitted. The production shall bear the costs.

(6) Performers are generally self-employed and are themselves responsible for the taxation of their income, social insurance and any required registrations. We do not pay taxes or social security contributions and do not provide tax advice.

§ 12 Services and Conditions for Productions

(1) Services for productions are intended exclusively for businesses. Consumers have no right of withdrawal in respect of these services. Prices are stated on the price page for productions and in the Customer area and are exclusive of statutory value-added tax.

(2) Tokens are ordered in packages and credited upon receipt of payment. For each activation of a set card, the number of Tokens displayed before activation is debited; a second activation of the same set card is free of charge. Tokens do not expire, are non-transferable and are not paid out in cash. If we terminate the contract for a reason for which the production is not responsible, we will refund the proportional value of unused Tokens.

(3) Subscriptions are paid in advance for a term of one, three or twelve months. They end automatically upon expiry of the term without requiring cancellation and are extended only if the production orders an extension. The Tokens and units for highlighted job offers included in the package are credited monthly. If a payment is reversed, we may terminate the subscription and reclaim credited services that have not been used.

(4) Job offers are reviewed before publication. They must be directed exclusively at adults, must be truthful, must accurately describe the type of production, content and remuneration, and may not contain any contact details. We may reject job offers without giving reasons and remove published job offers in the event of violations.

(5) Productions undertake to comply with all laws applicable to their productions, in particular laws on the protection of minors, proof of the age and identity of all participants, occupational and health protection, data protection and copyright, to conclude written contracts with performers, to comply with the agreed limits and to pay the agreed fee in full. Remuneration for placements by our team shall be governed by a separate agreement.

(6) Productions receive invoices electronically. Unless otherwise agreed, payments are due in advance.

§ 13 Referral Program

(1) Adult users with an account may participate in the referral program free of charge. The participation terms on the referral program page apply and form part of these General Terms and Conditions.

(2) Advertising for porno-casting.net may only be directed at adults, must be truthful and may not contain any promises regarding earnings or bookings. Self-promotion, multiple accounts, registrations under a false name and advertising by spam are prohibited. In the event of misuse, the points concerned shall expire, and we may terminate participation.

(3) Recipients are responsible for taxing commissions themselves.

§ 14 Moderation of Content and Reports

(1) We review profile cards and job offers before publication through our team. In addition, we use automated filters that obscure contact details in messages before they are released, detect prohibited terms in job offers, and limit the number of messages and enquiries. Decisions on restrictions are made by a human.

(2) If content violates applicable law or these General Terms and Conditions, we may remove it, restrict its visibility, suspend publication of a profile card or job offer, block the use of individual functions, or temporarily or permanently suspend the account. In doing so, we take into account the severity of the violation, whether it has been repeated, and the legitimate interests of all parties involved.

(3) We inform the affected person of a restriction and provide reasons, unless this is prohibited by law. The person may challenge the decision by e-mailing info@porno-casting.net; we will then re-examine the case through a person who was not involved in the initial decision, where possible. The right of recourse to the state courts remains unaffected.

(4) Any person may report unlawful content using the reporting procedure described in the Imprint. Messages may also be reported in the inbox.

§ 15 Term, Termination and Suspension

(1) The gratuitous user agreement is concluded for an indefinite period. Users may terminate it at any time without notice by requesting the deletion of their account in the Customer area or by sending us an e-mail. We may terminate the gratuitous user agreement by giving two weeks’ notice in text form.

(2) The right of both parties to terminate the agreement extraordinarily for good cause remains unaffected. Good cause exists for us in particular if a person is a minor, misrepresents their identity, uploads content within the meaning of § 8 Abs. 1, seriously harasses other users, or repeatedly violates these General Terms and Conditions despite having been warned. In serious cases, a warning is not required.

(3) Upon termination of the agreement, we delete the account and the content in accordance with the Privacy Policy. For services already paid for whose term has not yet expired, we refund the pro rata amount if we terminate the agreement for a reason for which the user is not responsible.

§ 16 Availability

We endeavour to ensure the availability of porno-casting.net with as few interruptions as possible. Maintenance work, security measures and disruptions outside our sphere of control may result in temporary restrictions. There is no entitlement to constant availability for gratuitous services.

§ 17 Liability

(1) We shall be liable without limitation for damage arising from injury to life, body or health, for damage based on intent or gross negligence, under the Product Liability Act, and to the extent covered by an assumed guarantee.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability shall be limited to the damage typical for the contract and foreseeable at the time the contract was concluded. Essential contractual obligations are obligations whose fulfilment is what enables the contract to be properly performed in the first place and compliance with which the contracting party may regularly rely on.

(3) In all other respects, our liability for damage caused by slight negligence is excluded.

(4) The above limitations of liability shall also apply for the benefit of our statutory representatives, employees and vicarious agents.

(5) We shall not be liable for statements, content or conduct of users or for the performance of production agreements, unless we are ourselves responsible under paragraphs 1 and 2. In all other respects, the liability rules of Art. 4 to 8 of Regulation (EU) 2022/2065 (Digital Services Act) shall apply to third-party content.

§ 18 Data Protection

We process personal data in accordance with our Privacy Policy.

§ 19 Amendments to these General Terms and Conditions

(1) We may amend these General Terms and Conditions with effect for the future if the legal situation or our services change or if there is an objective reason. For ongoing agreements, amendments shall apply only with the user’s consent. We will inform you of the planned amendments in text form at least four weeks before they enter into force and ask for your consent.

(2) If a user does not consent to the amendments, the existing conditions shall apply to ongoing paid services until the end of their term. In this case, both parties may terminate the gratuitous user agreement in accordance with § 15 Abs. 1.

§ 20 Final Provisions

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded to them by mandatory provisions of the law of the country in which they have their habitual residence.

(2) If the user is a merchant, a legal entity under public law or a special fund under public law, Berlin shall be the exclusive place of jurisdiction for all disputes arising from this agreement. We shall also be entitled to bring an action at the general place of jurisdiction of the opposing party. Statutory exclusive places of jurisdiction remain unaffected.

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(4) If individual provisions of these General Terms and Conditions are invalid in whole or in part, the remainder of the agreement shall remain valid. The statutory provisions shall replace the invalid provisions (§ 306 Abs. 2 BGB (German Civil Code)).

(5) These General Terms and Conditions are offered in several languages. The German version shall prevail; the translations are provided for information purposes.

Instructions on the Right of Withdrawal

Consumers have the following right of withdrawal in respect of contracts for paid services concluded via porno-casting.net, in particular regarding the verification fee. These instructions follow the statutory model.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which the contract was concluded.

To exercise your right of withdrawal, you must inform us (DATAsoft Webservice GmbH, Friedrichstraße 155, 10117 Berlin, Telephone: +49 30 20965-6680, E-mail: info@porno-casting.net) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs arising from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we received the communication concerning your withdrawal from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us an amount which is in proportion to the services already provided, in comparison with the full coverage of the services provided for in the contract, up to the time you inform us of the exercise of the right of withdrawal in respect of this contract.

Expiry of the Right of Withdrawal

In the case of a contract for the provision of services, the right of withdrawal shall expire if we have fully performed the service and have only begun to perform the service after you have given your express consent to this and at the same time confirmed your awareness that you will lose your right of withdrawal upon complete performance of the contract by us (§ 356 Abs. 4 BGB (German Civil Code)). In the case of the verification fee, the service has been fully performed as soon as the verification has been carried out and its result has been determined.
