A Buyout is the one-off payment with which a production permanently acquires the usage rights in the recordings as described in the contract. You are paid for the shoot day; the production keeps the material and everything it later earns with it.
The default in this industry
On photo and video productions in Germany the Buyout is the rule. The day rate is at the same time the settlement for the rights: 250 to 600 euros on photo productions, 400 to 1,200 euros on video productions, depending on role, shoot length and content.
An ongoing share in sold scenes is not part of that. Where a share is actually paid, a different business model sits behind it: webcam runs on platform payout rates between 25 and 90 percent, and your own fan platform is your business anyway, not the production’s.
The term itself says nothing about the amount. A Buyout can be adequate or poorly paid; that is decided by the figure in relation to the scope of the rights.
Predictability against a ceiling
The advantage sits in certainty. On the shoot day you know what you earn, regardless of whether the scene sells well or never appears. The exploitation risk sits with the production.
The price for that is the ceiling. If the material is sold over years on several portals, sublicensed and recut, it remains that one amount. There is no later claim because it went better than expected.
Neither is inherently better. It is a distribution of risk, and for newcomers the predictable variant is usually the more suitable. How the ranges work after deductions is shown in the article What a performer earns.
Scope and duration belong in the fee negotiation
A Buyout is not a price for a thing; it is a price for a scope. Permanent, worldwide and across all channels is considerably more than two years for the German-speaking area on one platform, even if the difference in the contract is only one line.
That is why both are negotiated together. Anyone who talks only about the figure and skips the scope of rights is negotiating half. Conversely a wide Buyout can be in order if the fee reflects it.
On the first bookings the room is realistically small. One thing is still always possible: ask what the Buyout exactly covers, and then find the answer again in the contract text. If the two diverge, the text prevails.
Four sentences that should stand in the contract
- that the fee expressly covers the grant of the rights
- which scope is meant, meaning period, territory and channels
- whether and in what frame sublicensing to third parties is allowed
- which items are billed besides the Buyout, for example expenses or waiting time
