Age proof and the documentation duty on set

The age proof is the first process of every porn production and for many the most alienating: before content is spoken about, you are meant to hand over your ID and allow a copy. That feels like mistrust, but is the opposite. The documentation of legal age is the basis on which it is possible to produce and exploit legally at all, and in the end it also protects you. This article explains which documents apply, what happens to the copy, what the ID-Shot is for and why a production without a check is the larger risk for you.

Why documentation happens at all

The making and distribution of shots with minors is a serious criminal offence. Anyone who produces must therefore be able to prove that all participants were of legal age, and this proof must still be leadable years later.

On top of that comes the exploitation side. Large platforms and distribution partners only accept material if the producer can hold proofs of age and consent of all participants. Without these papers a film is not played out, independently of how good it is.

The check is therefore not directed against you; it is the precondition for your work being paid and exploited. A production that does not check you either has no distribution path or no order.

Which documents apply and which do not

Recognised are the national ID card and the passport. Both are official identity documents that evidence your identity and your date of birth and that can be checked for authenticity.

The driving licence does not apply. It is a driving permission and not an identity document in the legal sense; it does not evidence your identity in the same way and is therefore not accepted. The same applies to membership cards, student IDs and photos of documents on the phone.

The document has to be valid, that is not expired. With us there is no casting without a valid document, and that is not a matter of discretion: even with someone who is visibly well over eighteen a check is made, because a proof is needed in the file and not an impression. What otherwise happens at the appointment is in the process.

What happens to the copy

The production takes a copy or a scan into the papers of the shoot, together with the contract, the consent and the limits list. This file is the proof it has to lead towards authorities and platforms.

It is kept as long as the production exploits the material, and additionally as long as statutory retention duties for business papers run. We deliberately do not name concrete numbers of years here, because these deadlines are regulated by statute and were last changed. The binding deadline the production or a tax adviser names to you.

Only those who need the papers may see them: the responsible person in the production, if applicable the bookkeeping, inspecting authorities and platforms within their proof requirements. The crew on set does not belong to that. If your ID is passed around on set or lands in an open cloud, that is not a detail, but a reason to end the day.

Two questions you may ask

First: who is responsible for these papers, and how are they stored? A serious production answers that without hesitation and without being offended.

Second: can I cover details that are not needed for the age proof? On copies it is common to black out fields that are not needed, for example the access number or parts of the serial number. Whether that is possible in the individual case the production decides by its proof duties — asking costs nothing, and the answer tells you something about the house.

What you cannot negotiate, by contrast, is the proof itself. Anyone who tries that is not booked, and that is right.

The ID-Shot in front of the camera

Many productions film before the shoot a short sequence in which you hold your ID document to the camera and name your name and the date, sometimes together with the confirmation that you are participating voluntarily and agree with the agreed frame. That is the ID-Shot.

It has a simple purpose: it joins person, document, date and consent in one shot that was not assembled afterwards. For a check that is the most robust proof there is.

What matters is what happens to this shot. The ID-Shot is documentation material and not part of the film. It is not published, not cut in and not integrated into the finished material. Have that confirmed before the camera runs — and if you want it in writing, that is a normal request.

Some productions additionally take at the end of the shoot day a short confirmation that everything ran within the agreed frame. That is not widespread everywhere. Where it is offered, it is a good sign, because this shot documents not only the production, but also you.

The conflict of aims: data protection against the documentation duty

There is no comfortable dissolution here, so we name it clearly: you put sensitive data into other hands so that a statutory duty can be fulfilled. Data protection says as little as possible. The documentation duty says as much as is needed for the proof. Both apply at the same time.

Anyone who works under a stage name feels that twice, because pseudonym and ID copy do not exclude each other here, but sit in the same file. That is the price of working legally. What remains possible outwards with a pseudonym is in working anonymously: what works, what does not.

What eases the conflict is not less documentation, but better: clearly named responsible persons, encrypted storage, no circulation on set, no passing on to third parties without a reason. That is exactly what we check before we book, and our own rules on data and deletion are under safety.

Why the production without a check is the more dangerous one

The thought is understandable: anyone who does not check also stores nothing, and what is not stored cannot leak. In practice it is the reverse.

A production without an age check has no order, no functioning legal department and usually no legal distribution path. It can neither assure you where the material goes nor that it is exploited legally at all. If something goes wrong there, there is no file with which it can be proved what was agreed — and this file is in a dispute also your evidence.

On top of that: anyone who is careless with the ID is so with other things as well. With contracts, tests, breaks, payment. The age check is therefore a good early indicator, and further features by which you recognise doubtful providers recognising dubious offers collects.
